Abstract

Questo articolo esamina come le leggi internazionali e nazionali si intersecano con l’abuso e la frode dei diritti e cosa significa per l’amministrazione della giustizia. Il concetto di abuso dei diritti è fondamentale in molte aree del diritto ed è particolarmente pertinente nel contesto delle leggi, dove è essenziale per preservare la legittimità dei sistemi legali e garantire l’amministrazione della giustizia. In diretta opposizione, il termine “frode” si riferisce alla deliberata falsa rappresentazione o all’inganno dei fatti al fine di ottenere un vantaggio o un beneficio ingiusto. L’articolo esplora le difficoltà che si presentano quando si affrontano situazioni che contengono sia la frode che l’abuso dei diritti, nonché il modo in cui queste due nozioni interagiscono nelle leggi internazionali e nazionali. In esso si sottolinea quindi il valore di un approccio equilibrato a queste sfide e si offrono tattiche per promuovere la giustizia in casi difficili e complessi, basandosi su studi di casi e ricerche giuridiche. Il lavoro conclude che, per garantire che le leggi internazionali e nazionali raggiungano gli obiettivi prefissati di promozione della giustizia e salvaguardia dei diritti umani, è importante un’analisi approfondita dell’intersezione tra frode e abuso dei diritti.

 

This article examines how international and domestic Laws intersect with rights abuse and fraud, and what it means for the administration of justice. Directly in opposition, the term “fraud” refers to the deliberate misrepresentation or deception of facts in order to gain an unfair advantage or benefit. The article explores the difficulties that occur when dealing with situations that contain both fraud and rights abuse as well as how these two notions interact in international and domestic Laws. The article emphasizes the value of a balanced approach to these challenges and offers tactics for advancing justice in difficult and complex cases by drawing on case studies and legal research. The paper concludes that in order to ensure that international and domestic Laws achieve their intended goals of advancing justice and safeguarding human rights, thorough analysis of the intersection of fraud and abuse of rights is important.
