Abstract

L’adeguamento della normativa italiana sulla privacy al GDPR (General Data Protection Regulation) ha fatto emergere una questione giuridica ancora oggi molto complessa.
Da un lato, c’è la necessità di tutelare la privacy delle persone e, dall’altro, la necessità di non bloccare il traffico legale e di non danneggiare le imprese.
Lo studio di questo problema deve mirare alla migliore soluzione che concili entrambi gli interessi e comporti il minor costo possibile per le piccole e medie imprese, soprattutto quelle soggette a procedure semplificate.
La soluzione migliore, a parere di chi scrive, è non applicare le stesse regole ad un gruppo indifferenziato di operatori, poiché trattano dati personali di persone fisiche per finalità diverse, ma occorre un provvedimento ad hoc per le piccole e medie imprese per non gravarle di costi eccessivi che potrebbero causarne l’uscita dal mercato.

The adaptation of the Italian legislation on privacy to the GDPR (General Data Protection Regulation) has led to the emergence of a legal question that is still very complex today.
On the one hand, there is a need to protect the privacy of individuals and, on the other, there is a need not to block legal traffic and not to damage businesses.
The study of this problem must aim at the best solution that reconciles both interests and involves the lowest possible cost for small and medium-sized enterprises, especially those subject to simplified procedures.
The best solution, in the opinion of the writer, is not to apply the same rules to an undifferentiated group of operators, since they process the personal data of individuals for different purposes, but an ad hoc measure is needed for small and medium-sized enterprises to in order not to burden them with excessive costs that could cause their exit from the market.
